Sep 12, 2011 - In a massive and historic outpouring by practicing chiropractors, students and patients the chiropractic profession is demanding that the United States Department of Education consider a series of complaints being lodged by the profession regarding the governance of the non-profit group that controls accreditation of chiropractic schools - the Council on Chiropractic Education (CCE).

Through Facebook, Twitter and e-mail, at least 6000 chiropractors appear to have expressed their frustration with what has been called a “Cartel” and “monopoly” by the Federal Government’s Committee that regulates the CCE which is the chiropractic profession’s only accrediting agency. The majority of chiropractic regulatory boards require graduation from a CCE accredited chiropractic institution in order to get a license to practice in the state.

In addition to the unusual control the CCE has over the licensing of chiropractors it is also considered part of a Cartel within the profession consisting of various testing agencies, licensing boards, state and national trade organizations and companies doing business within the profession.

At issue is the systematic remaking of the profession by these groups into a branch of medicine. So effective has been the cartel’s campaign to overhaul the profession that chiropractic can no longer be considered to be a drugless profession since chiropractors can now prescribe certain types of drugs in some states and at least one school, National University of Health Sciences, has changed the name of its educational program to Doctor of Chiropractic Medicine and has just recently been accredited by the CCE to offer it.

With their virtually complete control of the education and licensing of the entire chiropractic profession, the CCE has recently changed its Standards by which chiropractic educational programs are accredited. Those changes include the characterization of chiropractors as primary care physicians while removing the designation of chiropractic as occurring without drugs and surgery. Most significant is the complete removal of the chiropractic profession’s reason to be – the vertebral subluxation. Since its inception, chiropractic has focused its clinical practice on the identification and management of this spinal problem which results when the bones of the spine lose their normal position or do not move properly, subsequently interfering with how the nervous system works.

This has set up a perfect storm for a battle between those within the profession who wish to give up their traditional, conservative practice to take advantage of a broader scope through a merging with medicine and those who wish the profession to remain separate and distinct from organized medicine and keep its focus on the analysis and correction of vertebral subluxation.

The outrage by the conservative factions within the profession has its timing along with an upcoming hearing before the National Advisory Committee on Institutional Quality and Integrity – the Committee of the USDOE that regulates accrediting agencies such as the CCE. The CCE is up for consideration of its recognition by the Federal Government as part of a regular five year review and chiropractors are hoping to use the hearing to put a stop to what it sees as a hijacking of the profession by rogue groups closely involved with the CCE.

Dr. Fred DiDomenico: Now that person will stay, you give him a few exercises at home which we’re going to talk about next and put a curve in his neck and he gets off his blood pressure medication. My god, he’s going to with you forever. He can be so excited about his care. Now guess what kind of referrals you're going to get. People with blood pressure problems they're not coming in because of the back pain. They're coming in because they're scared of their heart problems.

And that's what we see in Elite when we teach people how to do this then, your referrals come in with organ problems and health conditions and less pain.

Dr. Brian Capra: Mistake # 3 - The have to know what they are buying

Dr. Fred DiDomenico:Mistake #3, they have to know what they're buying. And this is a huge thing. When you're to report of findings and you show them, you can show them the x-rays. But how many times have they been, to six other chiropractors, do you want to be in the seventh or do you want to be their last. And this is a thing -- we’ve shown some spinal corrected techniques. Even if you're not in CBP or Pettibon , but there are a couple of things you can do.

One of the most important is a stress test. Because when your telling them “Hey, you don’t have a curve in your neck” and this represents disease according to principle of chiropractic. And its normal one represents health. Then what can we do to take them there?

Now what's the probability that another chiropractor taught him the same thing? They went and they’ve got out of pain, now they still have that problem. In fact now, there is more of the generation and so what's going to be different about you that's going to make them commit when they’ve never committed to a chiropractor before.

How are you going to make them act or inspire them to act differently with you than what they have done before? How many patients say have come in, “My last doctor didn’t take x-rays.” Or you know, “He only recommended 12 visits and you're recommending 30.” Or “The fee structure is different.” I mean is that a common objection. Well here’s how you get through those objections.

Let’s go to the next slide. Again, spinal correction is tangible. There’s a thing called Denneroll and it can help the doctor who knows nothing about spinal correction, made predictable changes on post x-ray. So let’s show you.

This is real easy, here’s a way -- here’s someone comes, takes an x-ray, a denneroll is like a very dense foam role with a very specific shape in it. And what you do is you have a patient lay on that denneroll and then take an x-ray of them. So if you hit that again. There you go.

Now this is a person laying on a denneroll. That black area right behind their neck, you could see how it’s very densely black. That's the denneroll, you can kind see the shape of it. And what it does is down by the shoulders it’s got a little wave. Now that actually puts in, helps to upper thoracic curve. The upper thoracic curve is what forms the cervical curve. Now when they lay down and they lay over that denneroll then, look at the change in that structure.

Now yeah, I get there’s people they're saying, “Well that's because we're lying over the back of that”. And well that what my patients are going to say. Well, that's exactly right. Now here is the benefit. Ligaments creep. You guys know that when you look that ligaments can deform according to a sustained position. So when they lay on that denneroll, you get plastic deformation, what’s that mean? The ligaments will deform and actually hold that deformity after about 20 minutes. Now begins at 10 minutes, the greatest deformity of ligaments happens between 10 and 20 minutes.

So if they can lay on that denneroll for 20 minutes and they do that everyday in about three months, you're going to stand them up and that's what their curves going to look like. So when you look at this person that has a slightly reversed curve at top. But basically, no curve through the neck and then she lays -- this was a staff member of a clinic I was coaching. And then she lays over that denneroll look at the change in that curve.

Now in three months if she does that everyday, that's what her curve is going to look like. So as long as you know where to place the denneroll and you place it in the right place. Now, how do you figure that out? Hey, wherever you want to push the neck forward basically. And you can take a couple different x-rays with different placement, what’s that Brian?

Dr. Brian Capra: Yeah, I just going to laugh at that but one of the things that’s interesting with this too, it just, I don’t know if I really told you this, but I was using this for my stress x-rays but I didn’t have an x-ray unit where I could take it while they were laying down. So, I would go flip them on the table, have them lay for 15 to 20 minutes have them stand up and take a post x-ray.

And even though they weren’t on it, it’s still made changes. I mean there was still a change there even though they were standing which I know 10, 15, 20 minutes later during the day that went back towards their normal posture. But they actually were able to see that even though they were standing within 15 minutes of doing just a stress x-ray, they were already getting changes.

Dr. Fred DiDomenico: And that is phenomenal.

Now, people that have degeneration where their spines really stiff, you're not going to see those bigger changes. So what they need to do is get on it for a little while until they can tolerate 20 minutes and then do a stress x-ray. But they have this emotion, not too much degeneration. You can literally do this on day two. So arrive and say, hey, I'm not going to -- you don’t give them all the recommendation. We’re just going to do this test and let’s come back tomorrow and look at the test and then well make our recommendations from there.

Now when you’re showing a person, see this is what were talking about. They know what they're buying and that's something tangible and it’s not based on your opinion. They’ve been to other doctors, they gave them their opinion and maybe it worked temporarily, maybe it didn’t. But you showed them a corrected x-ray, like exactly what you said Brian. Hey, they’re allowing this thing for 15 minutes and you stand up, you get a picture and then, “Oh, my God that changed.” And you're like, “Look, you can do a lot better than this.” What that tells me is if you do this program and you add the adjustments that you're going to get that result and much greater in a short period of time, which maybe two to three months.

Now, they know what they're buying. And after coaching several doctors through a spinal correction and using it, that x-ray, right there people will drop money. They’ll say, “Okay, they have to know what they're buying.” And that's huge. It’s not an opinion like you said. So their goals happened to know what they're -- why they're buying your care.

Now if you say “Hey”, let’s say you have again, going back to the example of that woman that so tired she doesn’t feel like a good mom. And their marriage isn’t the same and then you do a denneroll x-ray. So its not, here’s the thing, even with postural corrective – in spinal corrective doctors. It’s not about putting the curve in their neck. It’s not about going from 10 degrees to 30 degrees. It’s about what does 30 degrees represent to that person. Now that denneroll test doesn’t mean you went to 30 degrees, it means, you're going to have better energy. So you use one liners, every time you lay on that denneroll, your boosting your metabolism. Now how often is she going to do that? Everyday?

Dr. Brian Capra: That's when you get to people like, “Oh, I brought it to work and I’m on my break I was laying in the break room on the denneroll.” That's when you get to doing that. You're like what?

Dr. Fred DiDomenico: I love people that have no shame. They don’t know shame but that's how emotionally driven they are. Now, when you can do that and you give them those one liners, my god, they’ll be laying out in the middle of the street stopping traffic because that's how much it means to them. Now you’ve got a patient with that level of commitment guess what gang? How many referrals are you going to get?

So while she’s lying in the break room and people go, “what the heck are you doing?” “Because I’m putting a curve in my neck, you should go to my chiropractor”. Make sure that woman have the bunch of your business cards.

Dr. Brian Capra: Yeah, write your number on the denneroll.

Dr. Fred DiDomenico: Yeah, exactly. Put your clinic sticker on there man, because you're going to be getting stuff going on. And what she going to do, now you know this Brian. If you give her that one like, every time you lay on this, you’re boosting metabolism. So the minute she’s lying in the break room on that dirty floor, then what’s going to happen. Then people go, “What are you doing?” She’s going to say, “I'm boosting my metabolism.” Right there they're going to go, “What -- that's cool. How are you doing that?” Man she’s just teaching, now she’s teaching, probably a care class on the floor of the break room.

That is what we want. So that's totally awesome and that's what you’ll see when you follow these procedures. “Luck is when preparation meets opportunity”.

Every report or findings is an opportunity. Another opportunity, my question that you have to ask -- that I’m going to ask you and you have to ask yourself is, are you prepared? Quit talking so much and then prove what you can do with the simple test like this and you’ll be amazed at the results you're going to get on that opportunity. Whether its marketing or compliance or billing, coding for that matter and actually, some of his clients that use our system have started to tweek the documentation system, the fact therein for the emotional hooks, etcetera. At the same time using and stay in compliance. So its actually pretty cool synergy on that level too.

But Dr. Fred, thank you so much for all the information and hopefully some people out there listening to this start to transition their thought process on where it is and how they should be communicating with their patients and help them find their “why” for what we do.

Fred DiDomenico: That’s where we get into coaching. And I did the "three problems" for years. Buckminster Fuller said, “You never change things by fighting the existing reality.” What does that mean? By doing the same thing over and over and over again and getting the same result of wanting something different. That’s the definition of insanity.

“To change something, you have to build a new model that makes the old model or the existing model obsolete.” That’s really the shift in communication and moving with the times. We’ve gone through economic changes. People in the last few years have been less willing to part with their money. It doesn’t mean they haven’t had the money, it just means they’ve been more skeptical about where they’re going to put it.

So, if we got to change that model and that consulting model is now obsolete, then what’s the new model? That’s where we get into coaching. Statements equals selling. Does anybody ever feel like you’re talking someone into care? That’s the most frustrating question that equals influence. If you want to create influence and get people from back pain into posture, into spinal correction, into whatever you’re delivering, then it has to be their idea. Once it becomes their idea, then they’re far more empowered and inspired to do. In fact, they’ll pay you anything and they’ll follow the recommendations.

So, how do we make it their idea? Again, I’ve already given you the clue. That’s the shift and the coaching. So, what coaching is -- if you look at a coach or an athlete, if you’re an Olympic coach and you’re coaching an Olympic athlete, a coach’s responsibility is to pull all the inspiration out of that athlete. When that athlete doesn’t feel good, the coach still pushes them to train hard that day. The coach reminds him of the goal. The athlete may commence, “I want to go to the Olympics,” and the coach trains him and inspires him and keeps that goal in front of their eyes.

Everybody has an emotional reason why. If you can’t find that emotional reason why, that’s why your patients are leaving. What they’re saying is, “You didn’t tell me why I should do this.” So for instance, once you go from pain into posture, you go through a coaching interview on a consultation, you have things like a woman could come in and I use this example. We are saying, “Hey, you have nerve stress on your neck,” or “Your posture on your neck is weak,” and that can cause, “Oh my God. I’m so tired all the time.”

Now, you speak to their emotion, “Wow, you sound really frustrated.” And they’re going to say, “Yeah, I don’t feel like a good mom,” or “Its affecting my marriage. I come home and I’m so tired. It’s hard to keep up with the house work.” You can just kind of get a sense, Hey man, maybe they don’t have enough intimacy in their marriage. Now, whatever service you’re delivering isn’t about change in their spine. It’s not about putting a curve in their neck. It’s about helping them have a great marriage, to feel like a good mom.

Now, if you can say, “Look, we can help you build your energy and metabolism,” she’ll pay you anything that you want because it’s not about a curve in her neck anymore. Now what it becomes about is she can feel like a fulfilled person and that’s life coaching. Now, one thing I did was I actually became a professional life coach. So I took life coaching communication and put that into a chiropractic consultation. I put that into a chiropractic exam and a pre-consultation.

That’s what coaching is. Every person has a reason why and when you find that reason why, their inspiration is going to go to a whole new level. Then the next thing is when you get into the ROF and you’re selling somebody their X-rays. Rather than you telling them what their problem is, you’ve got to see what they know. So, when you care more about what they know rather than what you know, then you’re going to start asking questions because we all know this stuff. “Hey man, how are you going to cure my neck?” I live by a chiropractic lifestyle. I know it. The thing is what do they know.

So again, when you start caring about what they know, then you’ll start to ask questions at your ROF. So you’re looking at an X-ray, “Hey, here’s normal and here is yours. What do you see?” Now, the funny thing is how many people in an ROF that you’ve shown, “Hey, you’re supposed to be curved and yours is straight,” and the patient says, “Well, isn’t it supposed to be straight?” They don’t get it. Have you run in to that before?

So then when you explain what that means, “Hey, a loss of a curve, major spines collapsing, the stretch is weak, you’re posture is distorted.” There are medical studies that show loss of curve is a weakened structure. Hey, that’s engineering and leverage.

And now, there’s also -- when you lose a curve, it strikes the spinal chord and then it shuts down the conductivity. So you basically say, “Hey, you don’t have a curve in your neck. The medical research shows the stretch is a curve. You have degeneration. Medical studies show that degeneration leads to a shortened life span.”

Here is where knowing a little bit of research makes a big difference. So you basically say, “Well, if this is the truth then how is that energy going to move in your body?” Now, you could say that energy is not going to move in your body but when you ask them how is it going to move in there, they're going to say, “Well, it doesn’t.” And then the third question about the organs that run off that life energy because they learned that on day one are depended on energy to keep you alive and healthy.

So, if they can’t move through this weakened posture and structure, then how is the energy going to bring health to your organs? Now, you can tell them, “This isn’t going to work,” but what if they don’t believe you? But when they say, “It’s not getting to my organs and that’s why I’m not healthy.” Here’s the difference and you know this from experience, Brian that when they say it, it becomes true. When you say it, they may not believe you. But it’s the funniest thing. When they say it, they believe it.

Now here’s a saying, “Rather than explaining to them for 20 minutes of how the body works, hey, just go look. Here’s what the research says about this,” and you don’t even have to use research but you speak in bullets and they go, “Well, what do you think that means?” And they’re going to say, “Well, that means I’m not going to be healthy.” Right there then you go to a consultation. That’s why you’re tired all the time. You have allergies. You’ve got in that car accident five years ago and in the last five years your immune system is weak. You get colds, you have asthma, and now you have heartburn. You’re on drugs, you’re on blood pressure medication, and you’re constipated. But it was all after you damaged your spine. Now look, this x-ray proves why that’s like that. Does that make sense?

Dr. Brian: Yeah, absolutely. So Fred, let me know if I'm getting ahead of myself here, getting ahead of you here. But I know that’s just from experience. I think it’s a really important point that you basically just explained like the woman that says, “I have little energy,” and then you go into that emotion and then that’s the why. You said that’s why they’ll do what you tell them they need to do eventually. It’s not the how, right? The how comes after the why.

Dr. Fred DiDomenico: Exactly. So regardless of what technique you use, and that’s exactly right. That is how. People don’t care how when they have why. I mean the person that says, “I want to climb Mount Everest.” Well, how hard do they have to train? They’re going to hire a coach to train them. That’s how they are going climb it. A person who is going to run Ironman Triathlon, all they care about is running through that tape. Now, what are they going to have to do to run through that tape? Hey, they are willing to go through hell and back on training to run through that tape. That’s exactly what you said, that having a better energy, to feel like a better mom, be more intimate with her husband. She’ll do anything hopefully to have that, right? And that’s when they’ll pay you anything.

Dr. Brian: So the thing is, is their why big enough to do what you need to do from the how perspective.

Dr. Fred DiDomenico: Exactly.

Dr. Brian: Cool.

Dr. Fred DiDomenico: Now the next thing and the last question on here, you have to show progression. But that’s not what's going to make man make him pay today. So they have to know, “Hey, if I don’t fix this,” and the basically often say, “Hey, what will happen if you don’t fix this?” They will go, “Well, my health is going to get worse.” “Well, do you want that?” “No.” “How that makes you feel?” “Well, terrible. I'm tired of being of being like this.”

Now, progression is one thing, but progression is why they just paid off their credit cards and they won’t pay you. Why? Their kid needs braces and they’re going to do that first. These are all excuses. Why? We’re saving up for the family vacation. What makes people start today is urgency and here’s one of the biggest mistakes. All management groups use progression. Very few are effective at urgency. So what you say is as you’re standing there right now, everyday you allow your condition to progress. What’s happening to your health?

So, it’s not that it’s happening. The worst thing you can say is, “What's going to happen in the next ten years?” What you just told them was, “I have 10 years to fix it.” So you have to say, “As you’re standing there everyday from this moment forward, what’s happening to your body?” Like from this moment every second, everyday, that’s urgency. That’s a huge, huge factor to why they’ll pay you today.

Dr. Brian Capra: Mistake Number 2 - Not focusing on organ problems

Dr. Fred DiDomenico: Number two is you’re not focusing on organ problems. Now, here is the thing, that’s the why. Studies show that the American population is pulling more money out of their pocket every year beyond their insurance company to get healthy.

So, the American public wants health. The baby boomers are driving the Gross National Product, same with the population driving Gross National Product for anti-ageing. People want to be healthy and that’s their why. It's not, pain. People come in motivated by pain in the beginning but every chiropractor knows how long does that last.

So there is something a heck of a lot bigger than pain. When you can find that is when they’ll pay and when they’ll stay. So, a huge mistake is not focusing on organ problems, but focusing on pain and how their pain is affecting their life. Now, there are management groups that say, “How is that pain affecting your golf game and how is that?” and they’re trying to find emotional hooks to they’re pain The reality is that’s great, but once the pain is gone then there’s no emotional attachment.

So when you have an emotional attachment tied to organ problems, number one, that’s the principle of chiropractic and number two, you’ve got something much bigger, so let’s look at how do we do that. Number one, they have to buy something much bigger than pain and chiropractic spinal correction is a big part of that because in the principle of chiropractic, it's optimal spine equals optimal health. The second thing is you have to have something tangible. Well, a pre and post x-ray is tangible. That’s one thing we specialize in elite coaching. It is showing people that have a desire to make structural correction.

We don’t have to be a rehab specialist, or have an engineering degree, or study years and years and years in techniques. There are a couple easy things that you can make with home care that can achieve that. You have to have something they can see. If it’s something they can feel when they feel good, they’re going to quit. It’s got to be something they can see that is tangible and they can conceptualize, okay? So, posture and spine correction is huge. We find once people convert that or have at least part of that in their delivery and that that’s something that’s beyond how they feel. That’s important.

So, people buy with emotion and justify with fact. Again, each patient has an emotional reason for long term commitment and we’ve gone through that. Our emotional commitment it’s based on our organ problem. It’s the guy that comes in and maybe he has neck pain or low back pain, and then I’m going through and teach him about posture and health going through the consultation and talk about organs. You find out if he’s got blood pressure problems or tachycardia. And then as you delv a little more, you find out he’s got a history of heart attacks, and then you find out you had two or three men in his family who died of heart attacks by the time they were 50 and he is 42 with blood pressure problems.

The guy is scared to death of a heart attack and he is coming in with back pain. You talk about that and then you find a cervical kyphosis, which definitely is going to cause stress on the heart and lungs and you talk about that, he’ll pay you anything you want. Every chiropractor has had the experience. Just adjusting people helps people get a blood pressure medication. That one is not even hard. A blood pressure and thyroid when you adjust the neck, those are very common. So you talk to a person about that, that’s an emotional hook.

Tactic # 10 - Fear, Uncertainty and Intimidation - SEE VIDEO
Interwoven into all of these tactics is a sense of fear, uncertainty and intimidation. A doctor fights back against an audit. Suddenly he hears his patients are getting letters stating he is under investigation for insurance fraud. They stop coming in, cash flow comes to a halt. Money owed to him on past claims is held by the insurance company, we'll apply it toward your settlement. They report the doctor to the state board. Even if he did nothing wrong the board will have to investigate and it will cost him. His reputation is trashed, his license is in jeopardy, legal bills skyrocket while cash flow comes to a standstill. What can he do except pay?
That is the extreme example. There is a much more subtle fear and uncertainty. It is a known fact that when there are too many decisions to make a person will choose not to make one if they can. With all of the coding rules, documentation, compliance, red flag triggers compounded by finding , hiring and managing billing staff the billing problem seems insurmountable. It's easier to go cash. That is when we let them win. Collect premiums and never pay. Then they take the money and audit more chiropractors.

Dr. Brian Capra: Hello, everyone. This is Dr. Brian Capra from Billing Precision. Today, we are lucky to have on the phone Dr. Fred DiDomenico from Elite Coaching. As you know, I love to do these webinars obviously outside of what Billing Precision offers our clients but it's a great synergy to have experts in our field on different aspects of practice come on and give their expertise on certain topics.

Dr. Fred is the owner of Elite Coaching and I’ve had actually some personal experience with his Elite Coaching system both in practice and as a part of what we do in Billing Precision. And I can actually say that Dr. Fred’s system is probably the only actual true coaching program not to bash any other coaching system out there, but it's true coaching program. One of the things that make it such is that it focuses on communication. At the end of the day, what you wind up feeling is basically rather than having to sell your patients or in Billing Precision to sell my clients, I'm actually able to learn how to communicate better with them so that they find their own inspiration if it's there to do by Billing Precision or become a patient in chiropractic.

So first of all, Dr. Fred DiDomenico, thank you so much for being on this call and thanks for getting into this.

Dr. Fred DiDomenico: Well, thank you. I think you summed up pretty well. That was one of my greatest frustrations in practice but as you know, I mean, we’re principal chiropractors and I think chiropractic is the best form of health care there is and it just got to be frustrating in practice when you’re feeling like you're having a talk to somebody into doing something that’s going to benefit their life and they just didn’t get it or for whatever reason they have objections.

And when I started applying coaching communication principles, I always thought people should be coming to us and begging us to be a patient. Yet, here we are with this great delivery, yet, we’re trying to talk people into it and that just never resonated with me, in fact it was very frustrating.

And so once we came up with this coaching application, coaches help people find the inspiration within themselves and when you find them around emotional reason, people come to you asking to be your patient, and I just found that that was a lot more fulfilling.

Dr. Brian Capra: Yeah, a lot less frustration, yeah.

Dr. Fred DiDomenico: And a lot less work.

Dr. Brian Capra: A lot less work and easier. I can tell you that’s 100% true. All right, I guess the title of today’s webinar is “The 3 Mistakes at Your Report of Findings That Are Causing Your Patients to Walk Out Your Door.” And again back to that, okay.

Dr. Fred DiDomenico: Yeah. And again, what this is -- the problem was I just found a correction so I could predict a clinical response and now there are people with many techniques. You can pretty much predict what response you're going to get from a patient clinically, but I couldn’t predict whether or not a patient is committed. And what we’re going to go through today are three mistakes that people commonly make of why you don’t know why they’re walking out the door.

So when you can take care of these, then your results on your ROF become much more predictable and search communication. And that’s what it says, “Communication tools that would take your practice and your purpose to a new level.” So let's go through that. We’re getting there.

Okay. Any entrepreneur, Brian, as you know, doesn’t say, “Hey, they didn’t get it.” They know their success is based on their communication. Communication is your success. So the effect of your practice is only as effective as your communication. So what we look at in chiropractic really, the strength and stability of a practice is in a patient visit average. What’s that mean? How many visits the average patient comes?

So if you take your office business per week divided by your new patient, that’s your PVA. And if you have a zero to 25 PVA, that means they’re symptom-oriented. It doesn’t mean that’s your intention, you may have corrective care recommendations, whatever that corrective care program is in your office. But if they’re basically coming zero to 25, then they’re getting rid of their symptoms. That’s they’re mindset.

If they’re coming 25 to 40, then they may be completing an initial corrective care but they’re not following through with maintenance. We look at the principle and philosophy of chiropractic, really it’s optimal, spine optimal health, and we want people to have a lifestyle of keeping their spine healthy.

So if they are averaging 20 to 40 visits, yeah, they may have followed corrective recommendation or their first set of recommendation but they’re not following through with the lifestyle. We had people coming 60 to 90 PVA. And when we’re talking about PVA, Brian, a lot of people, they take the PVA, the average visits of the people that commit. Well, we don’t do that because what if you only have 30% of your new patients committing? Then that’s a problem, that’s the day one problem.

So every patient that walks through your door and puts the pen on that application or that new patient intake form, they count as the statistic. So we have to average everybody in there, not just the people that commit but the people that walk out your door. Now, when you keep that stat, sometimes it gets a little bit scary.

So when you have 60 to 90 PVA, that means the majority of your patients are going through the corrective program whatever that may be, and they’re following through with some maintenance and that’s really the goal with the lifestyle of chiropractic.

Now, I have down here CBP. I actually used this slide on a presentation speaking to a group of CBP practitioners, but this really applied to any chiropractor regardless of the technique. So your PVA really is the strength of your practice.

MISTAKE # 1 - Talking Too Much

Number one, you're talking too much, and this is what most people do. And the thing is the smarter you are, then the more you want to tell them what you know, and that’s where the problem begins because hey, there are tenants at grocery stores, there are bank tellers, they sell cars or sell real estate, they don’t want to know what you know, okay, they have their own job. And sometimes when we’re so smart, we want to tell them everything we know and the more you're talking, the more you're talking them out of care.

So it's not how much you say, it's what you say and the impact, in other words, how they feel about what you say. And the reality is, the less you say and the more impactful, what you say is to them, the more they’re going to commit. So number one, there shouldn’t be a 45 or a 30-minute report of findings. You're talking too much.

Dr. Brian Capra: All right, that’s right. Is it basically what they feel about what you say or is it what they feel about you and what you say, or is it the feeling that they get after you say what you say?

Dr. Fred DiDomenico: Well, it's going to be both, Brian, because as you know, you went through some Elite coaching training and I think over 90% of communication is non-verbal. So when you're looking to influence studies on patients actually going to doctors of whether or not they followed the recommendations of the doctors. So when we look at the influence the doctor had over patient, only 7% of that influence was related to words.

So if you think what you're saying is influencing them, then you’ve got a 93% chance of failing. Tone had 38% and body language had 55%. So your body language, when you’re not moving and your body language doesn’t match your words and your tone, people won't trust you. So that’s number one. In other words, if you say, “I'm having a great day,” but your head is shaking no, people won’t believe you. They look at how you move not what you're saying.

And if your tone and body language match your words -- so to answer your question which is a great question, Brian, first, you're going to get a feeling, “Are you confident with what you're saying?” That means your body language and words have to match.

Secondly, they could be confident that you're an expert but they just don’t like your idea and that would take us to the next slide, to the next series of slides and that is, first of all, what you have to understand is if you want to change your practice, you can't do the same thing but harder. Now, you can't fix the problem with the same mind or the same communication that created it.

Now, let's go what most people have been doing and let's go to the next slide. And this is when you're talking too much and this is your idea, that’s consulting, even through most management groups. They say you have to answer the three questions, “What’s you're problem? How long is it going to take? And how much is it going to cost?” That’s you doing all the taking. That’s your idea.

Well, do you ever think, “What if they don’t like your idea?” It doesn’t even matter if you can help them. They just flat out and may not like your idea. And then you’ve got personalities because they just don’t want to be told what to do. And just the fact that you're telling them what to do, even if it's a suggestion and even if you use “My recommendations are--,” then that’s giving them a choice to choose wise, “Here’s my recommendation but you can do whatever you want.” And that’s where the weakness in your delivery starts happening. And if your body language doesn’t match your tone, you're using like, “Here’s what I suggest. What do you want to do?” Then you're communication pattern is just getting weaker and weaker.

Number one, it's your idea. Number two, it's a recommendation. It may not feel that solid. So now they don’t trust you and who knows how you're moving when you talk? And that is 50-year old chiropractic. I mean, we’ve been through that, our management groups have taught that for decades, and that’s just not as effective communication. So what is more effective?

Tactic # 9 - Post Payment Audits - SEE VIDEO
Now we have thoroughly explored the most common tactics used by insurance companies. The goal, to either prevent you from submitting claims or delay paying you for them. The latest trick up their sleeve is the post payment audit. This is where the look at the money paid to you and ask for it back, plus penalties, plus interest. It is scary by design. Insurance companies have figured out, using technology, who are the doctors who are least likely to defend themselves based on documentation, billing profile, practice size and other criteria we will never know. They have calculated that for every audit they pursue to the fullest they will get $13 dollars back for every $1 they spend. Not a bad way to make even more money. Remember we talked about in the beginning of this article, the insurance company takes your money that should be in your pocket and reinvest it? How do you feel now that you know their best investment is taking your money and auditing other chiropractors with it? What a racket and it is all legal. In some cases the accusation of insurance fraud has put the doctor out of business. Letters are sent to the patients by the insurance company. Complaints are submitted to state boards. Doctors are strong armed into paying just to avoid the legal battle. It's the modern day witch hunt. It seems hopeless on the surface but with the explosion of web based technology around the world the scales are tipped back in our favor.

I like that I can look at each claim individually and can clearly see how a claim was paid. I also am pleased that there is a log for each claim detailing the activity, as it let's me exactly what's being done to get the claim paid.

I REALLY like the Ticket feature. If I have a question or need a claim changed or edited, I simply send a ticket to my billing team and it is taken care of. The billing team that works with me answers all my tickets within less than 24 hours. They are polite, cordial and efficient.

Tactic # 8 - Documentation - SEE VIDEO
I have spoken to dozens of doctors who are so scared of not writing SOAP notes correctly they don't do them at all. Seems counter-intuitive but it is the extreme example of the documentation issue. Remember that your state board has requirements for daily notes that must be followed. That is not what scares doctors. What scares them is not knowing what the insurance company will accept as medical necessity. What is medical necessity anyway? I'm a chiropractor. The fear of getting it wrong is huge. Usually when I explain there should be a bigger fear of not doing it at all then getting it wrong, it is motivation enough. More on that in the next section. The rules for what is and what is not "medical necessity" are intentionally ambiguous just like coding, insurance verification and reading EOB. Know the game being played and do not fear it. If you at least look like you know what you are doing you will drastically reduce the chances of poor documentation biting you in the butt. You can get software to help with this. That's another subject.

Tactic # 7 - Benefit Verification
Have you ever called to verify patients benefits? I'm sure you have and I am sure you have also been frustrated when the person one the other end of the phone is in India and can barely speak English. This is not a mistake. It is a tactic. Other parts of the verification process are designed to ultimately cost you time and money, frustrate you to the point where you "go cash". There is the deductible family and individual, co-insurance/copay, allowable amounts, contracted amounts, in network, out of network, maximum benefits for a year and lifetime and so on. Hundreds of more combinations right? At the end of the call you think you know how much you might get only to find out the person gave you the wrong information. You have already submitted 20 claims, now what? This is no accident and it cost you at least 30 minutes in man hours to get the information. 30 minutes X $15/hour equals $7.50. It cost the insurance company maybe $1. They are kicking your butt. If it were $1 for you it wouldn't be so bad. Some docs are also outsourcing this to India. This is one thing we help our clients do. This process is one of those that takes so many man hours that it just drains your staff and they are unable to focus on patients when they need to.
